Based on interviews, the licensee did not comply with the section cited above in that, staff fed Child 1 (C1) from a bottle that belonged to Child 2 (C2), which poses a potential health, safety or personal rights risk to persons in care.
101223(a)(2) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. This requirement was not met evidence by: 1 Acting Director stated she will provide personal rights training to staff and provide proof of attendance to LPA by the due date. Based on interviews conducted by LPA, it was determined S3 handled day-care child in a rough manner and staff yelled at day-care child, which poses an potential Health, Safety or Personal Rights risk to persons in care. 8
Based on interviewed and self-reported unusual incident report, C1 was given the wrong milk bottle during feeding time for about 10 seconds, in which, C1 drank .5 ounces of formula milk. This poses and immediate health and safety risk to children in care.
101227 Food Service (7) Modified diets prescribed by a child's physician as a medical necessity shall be provided.(B) A child shall not be served any food to which the child's record indicates he/she has an allergy.The above requirement is not met by: Facility Director provided LPA with a written statement on how the facility will prevent this incident to occur again. On 9/19/23 Director provided LPA with documentation stating staff training on infant feeding prodedure on 5/19/23. POC was cleared on 9/19/23 evidence of facility serving an allergic item (egg) to Child #1 during lunch time and the Item was listed on LIC 702 Child's Preadmission Health History-Parents/Authorized Representative Report, LIC627 Consent for Emergency Medical Treatment, and Enrollment Application Information form which was received upon admission by the facility. This poses an immediate risk to Health and Safety to children in care.
101700.3 California Lead Action Level at Child Care Centers (b) Testing results with fractional ppb readings of 5.0 ppb or greater shall be rounded up to the nearest whole number, before comparing to the Action Level. (1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. 1 Director made site ID A inoperable by means of a sign that reads "Do Not Use". Water filtration system has been installed on the sink. Director will provide proof re-sample test documentation via email by 12/2/2022. Based on lab report analysis water from outlets A (844 parts per billion) and then retested A30 (25.9 parts per billion) taken on 10/14/2022 indicated levels of lead in exceedance. 8

This requirement is not met as evidence by: 1 DIrector stated she will condcut a "Personal Rights" training with staff and send LPA via email to dianna.valdezsantana@dss.ca.gov a copy of the staff sign in sheet and meeting agenda. Based on video and Staff statement of inappropriate behavior of S5 talking inappropriately and disrespectful toward the parent in front of the child.
