(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidence by: 1 Director agrees to sign a decleration acknowledging that she will care for more that the 18 toddlers as listed on the license. Based on observations, LPA observed 27 toddlers when the license only allows to care for up to 18 toddlers. This poses a potential risk to children in care. 8

Plans to alternate use of outdoor play space may be approved to achieve separation. This requirement is not met as evidence by: 1 Director agrees to sign a decleration acknowledging that she will not share space between pre school children and toddlers. Based on interviews, observations and record review, LPA observed children in the toddler program were sharing the same space as those children in the preschool program.
