101161 Limitations on Capacity (a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement was not met as evidence by: 1 Director is to submit a written plan on how the facility plans on preventing reoccurrence of this deficiency. Written plan is due by 3/14/24. Based on interviews conducted, and record review, Licensee did not comply with the deficiency cited above as an infant was admitted into care for one day which poses a potential risk to the health, safety and or personal rights of children in care.

This requirement was not met as evidence by: 1 Director is to submit a written plan on how the facility plans on preventing reoccurrence of this deficiency. Written plan is due by 3/14/24. Based on observation, interviews conducted, and record review, Licensee did not comply with the deficiency cited above as staff member does not have TB clearance on file which poses a potential risk to the health, safety and or personal rights of children in care. 8

Facility has taken the following steps labeled the four (4) outlets, and will notify parental notification of the water testing results, and are reviewing options to correct the ALE. Facility has until 11/18/2022 to correct the deficiencies or have a reasonable plan to correct them and notify CCL. Facility conducted water lead testing and had five (5) outlets exceed the action level exceedance per regulations. This poses a potential risk to the health and safety of the children in care
