Based on interviews and record review, the licensee did not comply with the section cited above when s1 grabbed c1’s arm in a rough manner, tapped c1 on the head in a flicking manner, and pushed c1 on the chest. C1 was upset and was observed crying after the incident which poses an immediate risk to the health, safety or personal rights of children in care.

Based on interviews conducted it is determined that Staff speaks to day care children in an inappropriate manner. It was revealed in multiple interviews that the tone of S1 to children in care was heard to be verbally aggressive.

Based on interviews conducted it is determined that Staff speaks inappropriately to other staff in the presence of day care children. It was revealed in multiple interviews that the staff while in the presence of children were heard and seen verbally arguing. On 05/29/2026 as the children were being put down for nap and still awake, it was witnessed that staff were arguing in the presence of children.

Assistant Director stated they will conduct a staff meeting and training based on CCLD videos. Proof of completion will be sent to the department by 07/31/26. S1 was seen leaving the Dolphin classroom to go the connecting play yard to the while supervising children in care without another staff member watching the children. It was revealed that there were other occurrences of the Dolphin class without appropriate supervision.

LPAs contacted Oakland Regional Office and confirmed both have working and eligible clearance. Support Staff helped transfer both clearances and associate them to license during LPAs visit. Per inspection, 2 staff KELLIE HERNANDEZ and MALIYA MANNING present today, providing supervision, were not associated to license. Both have been working for more than 5 days. This posed a potential risk to safety of children in care. 8 By 2/12/24 Director will send a written statement ensuring how facility will be in compliance with this regulation.
