Based on the information obtained from staff interviews, interview with law enforcement, and reviewing video footage, it was determined that a child sustained an unexplained injury while in care, which posed an immediate risk to children in care.

… 1 Director stated that in the event a teacher is sick during working hours, staff will be sent home. Facility will call substitute staff to come in and replace sick staff member. TSP was discussed and the Director accepted. Director also stated that she will review Personnel Requirement regulations with Management and staff and send in copy of agenda for the training and a copy of the dated sign in sheet. Based upon staff interviews, documents received the facility management did not comply with the section cited above which poses a potential health, safety and personal rights risk to children in care.

Based on observation and interviews, information showed that one aide was supervising 14 children in the penguin’s classroom and 1 teacher was supervising 13 children in the Koalas classroom for a period of 30-60 minutes on at least one or more occasions which poses an immediate risk to the health, safety and personal rights of children in care. 8 Written plan should be sent to LPA Sutherland by 8/10/23 via e-mail. LPA Sutherland will follow up with the plan at the facility to ensure it is effective.

Regional manager states that they have added more staff members on the playground to provide supervision. The littel playhouse has been moved to a different location in more viewable spot. based on teacher testimony, visual observation it was determined that there is an-viewable area that supervising teacher could not see. Day care children were not being properly supervised while 2 of them were harming another child. This posed an immediate/potential risk to the health and safety of children in care.

Incoming director has provided correction on today's visit. She will ensure that in the future incidents are reported on the duty line (619)767-2248 and submit an incident report by email to SDIncidentReports@dss.ca.gov or by Fax at (619 767-2203 within 24 hours of occurring. Licensee will also provide written statement explaining that she will submit future reports per the required time frames. This requirement was not met as evidenced by the department did not receive an incident report within 24 hours.
