(c)All information and records obtained from or regarding children shall be confidential. (1)The licensee shall be responsible for safeguarding the confidentiality of record contents. Based on record review and interview, the licensee did not meet the requirement stated above. 1 Today, Preschool Facilitator Gallegos stated they currently have a more efficient plan to collect documents. Mrs. Gallegos stated that the facility will submit their plan of how documents are collected, safeguarded and kept confidential. A written plan will be submitted to the Department by POC date 10/26/2022. It was determined that a physician's report that was submitted after 6/2022 could not be located today thus the facility could not confirm that the document was safeguarded or being kept confidential as required. This poses a potential health, safety, and or personal rights risks to children in care.

(b)All children shall be given an opportunity to nap or rest without distraction or disturbance from other activities at the center.(1)A napping space and a cot or mat shall be available for each child under the age of five. Today, LPA observed that the facility administration office had brand new napping mats that were cushioned and still in the packaging. Expanded Learning Administrator Mr. Camaquin stated the mats will be used as of Monday 9/12/2022. Based on observation and interview the licensee did not meet the requirement stated above. Today, LPA observed children napping without mats or cots and representatives confirmed the observation. This poses a potential risk to the health, safety and or personal rights of children in care. 8 They were delivered to the classroom while LPA was present today. Deficiency cleared today 9/9/2022.
