101238(a) Buildings and Grounds The child care center shall be...safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is not met evidenced by: 1 Facility made the fenced area inaccessible to children (during visit). Facility to replace wooden fence. Facility to fill in the floor with cement. Teacher will be placed in front of the hazardous points of the fence. Facility will send updates to LPA. Based on observation and interview, the wooden fence in the preschool play area has multiple holes from deterioration (approximately 6 inches from ground, 2-3 inches diameter), exposed rusted screws/nails and splintering wood (pictures taken), and broken cement (pictures taken). 8
Based on record review, the licensee did not comply with the section cited above in 1out of 5 children's files did not possess physician report (LIC 701) which poses/posed a potential health, safety or personal rights risk to persons in care.
1596.885 Denial, suspension or revocation of license... The department may... suspend or revoke any license... under this act upon any of the following...(c) Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility... This requirement is not met evidenced by: 1 During today visit, facility maintenance staff installed 3 new alarm devices: one on front entrance door, one on hallway door and one on the gate of the facility's playground. Director states she will submit and detailed plan to ensure the alarm devices are in working order during operation hours. Based on observation, interview and record review, the licensee did not adhere to the Stipluation Order regarding Egress devices - (1) Facility has only one alarm device installed on the hallway door, and (2) The alarm device that was installed on the hallway door, did not function appropriately during today's visit, which posed an immediate health, safety or personal rights risk to persons in care. 8
Based on observation, interview, and record review, the licensee did not comply with the section cited above in two out of five staff files reviewed did not have proof of immunization records, which poses/posed a potential health, safety or personal rights risk to persons in care.
