101238 Buildings and Grounds: The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. 1 The facility stated they replaced the AC vent filter immediately on the day of the incident. The director stated the facility will check AC vents and filters monthly to ensure safety. The director stated they will add to closing staff checklist to check AC vent and filter.

101223(a)(2) Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful, and comfortable accommodations, furnishings, and equipment to meet his/her needs. This requirement was not met evidence by: 1 Director stated she already had one on one meetings to refresh personal right and will also hold a all staff training on 10/21/23. Based on interviews conducted by LPA, it was determined that the facility handled child in a rough manner resulting in injury. This is a potential Health and Safety risk to the children in care. 8
