(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from...other actions of a punitive nature including but not limited to: interference with functions of daily living including...toileting; or withholding of...aids to physical functioning. A written plan of action will be submitted to LPA Pringle detailing steps staff will take to verify that the diapering needs of children in care are being met. This requirement was not met as evidence by: a child's personal rights were violated when facility staff failed to change a child's diaper which resulted in a diaper rash. This poses a potential risk to the health and safety of the children in care. 8

Facility will send teacher qualifications including transcripts to LPA via email or mail by due date of 12/16/2022 Based file review and interviews, the facility did not comply with the section cited above as 3 staff files did not have transcripts and two staff member's units could not be determined that the individuals to be fully qualified, which poses an immediate health, safety or personal rights risk to persons in care. 8 Failure to submit Proof of Corrections (POC) by Plan of Correction date may result in additional civil penalties.

Repeat violations are $250 per violation and $100 per day until corrected.
