This requirement is not met eveidenced by: 1 Director states she will submit a plan to ensure S1 will only be used to assist in the classroom in an emergency situation and is not on a regular basis, to LPA on due date. Based on interviews and record review, facility has been utilizing S1 to meet ratio in the classroom on a regular basis of 1-2 times a week, which posed a potential risks to the health, safety and personal rights to the children in care.
(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, This requirement is not met evidenced by: 1 Director stated facility has hired 4 extra staff to ensure staff to child ratio requirement are being met at all time. Director will submit a detailed plan to show that facility is meeting the ratio requirement at all time. Based on LPA observations on 05/15/24, 2 teachers were observed supervising 26 children in the Older Twos classroom on 05/22/24 and on 06/05/23, 1 staff supervising 16 children(13 napping, 3 awake including 1 child sitting at the table) in classroom Threes, which posed an immediate risks to the health, safety and personal rights to the children in care. 8
101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs. This requirement is not met evidenced by: 1 Director stated she had conducted staff meeting and addressed concerns with the involved staff. Director will submit a detailed plan to ensure staff are providing adequate supervision on the playground, to LPA, by due date. Based on LPA interviews and record reviews, all 4 staff members, who were present on the playground, did not intervene to redirect/stop C1 from causing injury to C2, which posed an immediatel risk to the health, safety and personal rights to the children in care. 8

This requirement is not met evidenced by: 1 Director states she will disenroll the three children, who are 6 years old, currently in the facility, as of today 06/05/2024. Based on LPA interview and record review, Director confirmed that facility was out of compliance with the license's terms by providing care for 3 children over the age of 6 years old, which posed an immediatel risk to the health, safety and personal rights to the children in care. 8

This requirement is not met evidenced by: Director states she will submit a detailed plan to ensure staff are not using the phone while providing care and supervision for the children in care, to LPA by due date. Based on LPA interviews, 7 out of 10 interviewed staff confirmed that S1 was being on their phone 50-100% of the time while S1 was providing care and supervision for the children in the classroom/playground, which posed an immediate risk to the health, safety and personal rights to the children in care. 8
101216.3 Teacher-Child Ratio (b) The licensee may use teacher aides in a teacher-child ratio of one teacher and one aide for every 15 children in attendance. This requirement is not met evidenced by: 1 Director states she will submit a detailed plan to ensure Teacher-Child Ratio is met at all time, to LPA by due date. Based on interviews and records review, teacher S1 and aid S2 were supervising 17 preschool children in the Twos classroom; teacher S4 and aid S3 were supervising 17 preschool children in the Older Twos classroom, which posed an immediatel risks to the health, safety and personal rights to the children in care. 8
101216.2 Teacher Aide Qualifications and Duties (d) An aide assisting a fully qualified teacher... in the supervision of up to 18 preschool-age children... shall meet the following requirements: (1) Completion of six...units in early childhood education...or (2) completion of at least two...units in early childhood education... and (3) Continuation in the educational program ...until six units have been completed. This reuirement is not met evidenced by: Director states she will submit a detailed plan to ensure staff meeting ECE qualifications in orer to provide supervision for the children in care. Based of interviews and records review, S2 and S3 did not meet ECE qualifications to assist qualified teacher to supervise 17 preschool children in the Twos and the Older Twos classroom, which posed potential risks to the health, safety and personal rights to the children in care. 8
