Based on interviews conducted, children sustained injuries from hitting their head on the handlebar in the classroom, hitting their head on the low-rise toy bin and hitting their heads on the wall when falling off the foam gym. This is an immediate risk to health, safety and personal rights of children in care

This evidence was not met as required by: The facility stated they will provide a plan of action on ensuring proper child observation and assessment of a child by due date 2/27/26 Based on interview and video review, Child 1 was not properly assessed after falling off the slide and sliding inappropriately. This is a potential risk to health and safety of children in care. 8
Based on observation, interview and record review, the licensee did not comply with the section cited above, Staff 1 in the toddler component room with an Aide did not have curriculum units and was not enrolled in curriculum class either, which pose a potential health, safety or personal rights risk to persons in care.
101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement is not met evidenced by: 1 Director stated that management team has met with S5 and addressed concern about S5's behavior and had taken action to terminate S5's employment. Director stated that she would provide proof of facility staff's retraining regarding personal rights to LPA by due date. Based on interview and record review, S5 was observed handling child C2 and C3 in a rough manner, which posed potential risks to the health, safety and personal rights to the children in care. 8
