101700.3(b)(2) California Lead Action Level at Child Care Centers:(b) …(2) Licensees shall maintain a lead value at or below the Action Level of 5 ppb in all outlets subject to the testing requirements of these Written Directives, for the health and safety of children in care. Facility representative stated that as part of the plan of action they have discontinued the use on indicated outlets A and B for drinking and food prep and are utilizing delivered bottled water. Outlet A will remain in use for handwashing only and outlet B will be capped off to prevent use. This requirement was not met as evidence by: On 03/03/2026, licensee failed to maintain a lead value at or below the Action Level for water lead testing resulting with values of 5.5 ppb or greater for outlets marked A and B. Water testing results identified with Action Level Exceedance as defined in Written Directive section 101700.3. are not deemed safe to drink. This poses/posed a health, safety or personal rights risk to persons in care. 8
