101223 Personal Rights- (a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... 1 POC- Director will have staff meeting on June 19,2024. Director must send and agenda for meeting with a plan to go over personal rights with staff. This is due on June 6, 2024. This requirement was not met as evidence by: Based on interviews conducted, Staff #3 said their hand was on child's head and child was crying. This poses a potential health, safety or personal rights risk to persons in care. 8
Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, written report containing the information 1 Cleared during inspection. Director provided a copy of written report to LPA during inspection. specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. 8 Based on interviews conducted with director, it was determined that a report for an incident that occurred on 1/31/24 was not reported to the Regional Office within the appropriate time frame. This is a potential risk to the heath and safety of children in care.

Licensee will send information to LPA by POC. Based on record review, Licensee did not observed an injury or ouch report in the child's file. In addition, staff failed to notify the Department by telephone to report an incident involving a child that required medical attention.
