101238 Buildings and Grounds (a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement is met as evidence by: Director provided invoice request for repairs playground gate/fence dated 5/19/25 and completed on 6/18/25. Director stated while fence was being repaired children were using front playground. On 7/16/25, LPA observed fence/gate replaced and repaired. POC cleared at time of visit. Based on LPA’s interviews and observation. LPA Duron observed facility’s outdoor fence with a broken latch, zip ties and a chain wrapped around opening of the fence. LPA Duron observed fence with corroded metal post on fence, which poses a potential health risk to the children in care 8

(1) A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. 1 LPA observed Site ID E located inside Classroom 3 with a sign that reads "Do Not Use." Director agreed to submit documentation to LPA once water retest is complete. Based on lab report analysis water from outlet E (25.600 parts per billion) taken on 11/30/2022 indicated levels of lead in exceedance. Staff ststaed the water is still be retested, 8

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature... Based on interviews with staff over the course of the investigation, it was determined that Staff #1 (S1) 1 The director stated that S1 involved in the allegation was placed on administrative leave, pending the completion of the investigation, and then after second reported incident S1 was terminated. Director conducted a "Personal Rights" and "Child Guidance" training with staff on 10/17/2022 and submitted agenda and staff sign in/out (See Confidential Names List LIC811) had inappropriately handled children in a rough manner while in care. 101216.2(e) Teacher Aid Qualifications and Duties. An aide shall work only under the direct supervision of a teacher. This requirement was not met as evidence by observation of LPA Tran on 10/28/21 that staff # 2 and staff # 3 were supervising a group of 7 children each in different classrooms. 1 Ms. Morley agreed to send an statement that she will not use the aides with no ECE in the classroom without the supervision of a qualified teacher. The qualifications for aides and teachers were discussed with Ms. Morley. Also observed on the CSR that one aid lacking 6 completed ECE units worked with a qualified teacher with 16 children on 10/13/21 from 10:00 am to 12:00 noon. This is a potential risk to the health and safety of children in care. 8
