This requirement is not met as evidence by: 1 Director agrees to write a statement of understanding in regard to staff-infant ratio, establish a list of infant’s weekly attendance schedule with days and times listed, and a current LIC500. Director agrees to submit proof of documents to LPA by COB 12/07/2023 via email. Based on interview and record review, the Licensee did not comply with the section cited above, the staff-infant ratio was not within 1:4 (one staff to 4 infants) the week of August 28, 2023, which poses an immediate Health and Safety, Personal Rights risks to persons in care.

101161(a) Limitations on Capacity, a licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. This requirement is not met as evidence by: Director agrees to write a statement of understanding regarding limitations on capacity, develop a plan to prevent exceeding capacity limitations and provide a current LIC500 to LPA by COB 12/07/2023 via email. Based on LPA observation, the Licensee did not comply with the section cited above on 09/05/2023, LPA observed a total of 26 infants in the infant classrooms and the maximum capacity is 24 infants, which poses an immediate Health and Safety, Personal Rights risks to persons in care. 8

Based on the interview and record review, the Licensee did not meet the Personal Rights 1 Interim Director agrees to read Personal Rights regulation and write a statement of understanding. Director also agrees to write a plan that details what steps the facility will take to prevent further biting. Interim Director agrees to provide Authorized Representative with supplemental Behavior Policy. regulation which poses an immediate Personal Rights risk to the children in care. There were at least 13 incidents documented involving a child being bitten, scratched and/or hit. The Interim Director confirmed the incidents reported did occur while in care. 8 The written statement and plan are due on 12/06/2023. Behavior Policy will be due within 24 hours of having a discussion with Authorized Representative. Interim Director agrees to submit plan of correction to LPA via email at Raymond.Moorehead@dss.ca.gov

Based on records review and interview disclosures, staff member(s) did not change a child(ren)'s diaper within a two hour timeframe which left a child(ren) in a wet or soiled diaper for more than two hours which poses a potential health, safety, and personal rights risk to children in care. 8 Director agrees to re-train staff on Infant/Toddler diapering policy and discuss the importance of documenting the diaper log consistently. Director stated training will take place on 11/02/2022. Director agrees to submit training agenda and training sign in sheet on or by 11/04/2022.
