Based on CD UIR notification received on 10/27/25 and document LPA received on 1/12/26 and CD admitting to not reporting the outbreak in a timely manner and the Department did not received the UIR notification within the Department’s next working day during normal business hours. This poses a potential health, safety or personal rights risk to persons in care.
Based on interviews with staff, child 5 was suspected of having Hand, Foot, and Mouth Disease on 7/7/25 and was not moved to the centers isolation area which poses a potential health, safety, or personal rights risk to persons in care.
Based on AD admitting to not reporting the outbreak that began on 07/07/2025 and the Department has no record of the incident reported to the Department within the Department’s next working day during normal business hours. Based on statement provided by AD, 7 staff and LPA’s observations of 2 staff supervising 9 children at 7:00 am, 2 staff supervising 11 children at 7:35 am and 4 staff providing care and supervision 21 children at 8:14 am on 12/12/24. 8 Furthermore, LPA intends to conduct a follow up inspection to verify compliance with ratio requirements.
Based on observation, at 9:35 AM, children from the infant license were co-mingling with children from the pre-school license in the playground outside which poses a potential health, safety or personal rights risk to persons in care. 8 outdoor activity space for infants and submit it to LPA by email at robert.maciel@dss.ca.gov.
Based on observation and record review, at 9:40 AM, LPA observed child 1 (C1) and child 2 (C2) sleeping on their stomachs and C1 and C2's LIC9227 Individual Infant Sleeping Plans did not indicate that they are able to roll over which poses a potential health, safety or personal rights risk to persons in care.
Based on record review, staff 2, 3, and 6 (S2, S3, S6) did not possess current Mandated Reporter Training Certificates which poses a potential health, safety or personal rights risk to persons in care.

The licensee shall ensure that each child is accorded the following personal rights; To be accorded dignity in his/her personal relationships with staff and other persons. This was not met as evidence by. . . 1 Center director reported disciplinary action was taken with involved staff. Center director stated intervention did occur at time of incident. Center Director will email LPA the POC. based on interviews conducted, during the verbal altercation between staff members at least two children were present. This poses a potential health and safty risk to children in care. 8
The licensee shall ensure that each child is accorded the following personal rights:To be free from… corporal or unusual punishment, infliction of intimidation, ridicule, coercion threat, mental abuse or other actions of a punitive nature. . . This has not been met as evidence by. . . 1 Center director reported assistant center director is taking more time working directly with the staff members of the classroom. Her training includes how to talk to the children, the approach to the children. More shasowing is being conducted to prevent this from happening again. We are making ourselves more visual in the classroom. We are begining to talk to them one on one and more support. Based on interviews conducted, interviews corroborated staff yelled at day care child on more than one occasion. This poses a potential health and safty risk to children in care. 8
Documentation shall be maintained in the infant’s file and be available to the Department for review. Documentation shall include the following: Date. Infant’s name. Time of each 15-minute check.Initials of staff person who conducted each check. This was not met as evidence by. . . The assistant center director agreed to have all staff undergo Infant Safe Sleep Training through TSP. LPA printed " Responsibility for providing care and supervision for infants" and reviewed the requirements with the assistant center director. Assistant center Director agreed to email over the safe sleep log for three infants to LPA on 03/28/2023. Based on observation, record review and staff interview the center was not complying with the regulation stated above for the 18 infants that were in the toddlers room since March 06th 2023. This poses a potential health and safty risk to childrfen in care. 8
All personnel records shall be maintained at the child care center and shall be available to the licensing agency for review. This poses an potential health and safety risk to children in care. 8
Based on observation, and interview, The "tods" room which is under the Infant license and provides services for infants 24 months and under was observed not using Cribs or portable cribs for infants while napping. LPA Hernandez Torres observed staff putting cots away. LPA asked staff in the "Tods" room the age of the infants and where they sleep. Staff replied the youngest in the room at the time was 11 months old and slept on a cot. LPA provided technical assitance and reviewed Safe Sleep Regulation with lead teacher in "tods" room and " infant" room as well as assistant center director. The Center did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on record review, four infants; C4,C6,C8 C10 were all missing LIC 701 physicians report. All infants have been enrolled longer than 30 days. The Center did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.
