No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidenced through interviews 1 Director agreed to update the procedures for the supervision while children using play yard. Director stated that there will be scheduled ussage of play yard and staff will communicate while taking any child for bathroom ussage. it was found that two children left the facility unattended and were returned to the facility by neighborhood resident after about 12 minutes. This poses an immediate health and safety risk to children in care. 8

In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. Events reported shall include the following: Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement is not met as evidenced that the facility did not reported an incident of two children’s absence to the Department. This poses a potential Health and Safety risk to children in care. 1 Director agreed to follow the requirement of reporting the Department within 24 hours via telephone and written report within seven days.
