Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above by ensuring all staff have eligible fingerprint clearance prior to working in the facility, which poses an immediate health, safety or personal rights risk to persons in care. The director is aware staff is not allowed to return to work until staff has eligible fingerprint clearance. Please check Guardian or contact the Oakland office to verify clearance.

Based on [(observation) (record review)], the licensee did not comply with the section cited above by ensuring all infants up to 12 months of age has the LIC 9227 file in form,which poses/posed a potential health, safety or personal rights risk to persons in care. LPA observed 3 infants sleeping on their stomach and 2 of 3 infants did not thave the LIC 9227 form in file.
(1) A licensed child day care center... constructed before January 1, 2010, shall have its drinking water tested for lead contamination levels on or after January 1, 2020, but no later than January 1, 2023, and every five years after the date of the initial test. 1 By 10/19/2023 the licensee will schedule an appointment with a certified water sampler to test the water supply for lead. Please send proof of appointment to LPA. This requirement is not met as evidence by: Based on interview and record review the licensee did not comply with the section cited above by ensuring the day care center water was tested for lead. 8 Once testing is completed, please submit the lead test packet to LPA, which includes lead test results, facility sketch, LIC 9275 form, and LIC 9276 form.
101179 Capacity Determination (a) A license shall be issued for a specific capacity, which shall be the maximum number of children that can be cared for at any given time. The Department may issue a license for fewer children than requested. This requirement is not met as evidence by: 1 The site administrator indicated he mailed an increase of capacity application in November 2022 but did not hear back from Licensing. The site administrator also stated the check submitted with the application was not cashed. The facility did not operate within the capacity of 12, which is specified on the license issued by the Department, which poses an immediate risk to the health, safety, and personal rights to the children in care. LPA observed 43 infants during today's visit. 8 By 03/15/2023 the facility will resubmit the increase of capacity application and pay required fees in person or will provide a copy of certified mail receipt to LPA.
