Based on observation, the licensee did not comply with the section cited above in that there was three Clorox Bleach spray bottles and one Borax detergent box found under the sink in Room 5 that were accessible to children. Based on observation, the licensee did not comply with the section cited above in that Room # 1 A and B was observed to be out of ratio with 25 children with 1 teacher and 2 aides and Room # 4 and 5 were combined and observed to be out of ratio with 25 children 1 teacher and 3 aides which poses an immediate health, safety or personal rights risk to persons in care.
Based on record review, the licensee did not comply with the section cited above in that Staff # 5 does not have a current Mandated Reporter certificate on file which poses/posed a potential health, safety or personal rights risk to persons in care.
Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department.(C) Any unusual incident... or safety of any child This evidence was not met by: 1 Per Principal, an Unusual Incident Report procedure was placed on the employee board for all employees to follow for future Unusual Incident Reports. LPA observed the procedure in place. Facility did not report an unusual incident report that occurred on 07/13/23 to the Department within the required 24 hours. Unusual Incident report was received on 07/18/23. 8
Based on interviews conducted by it was determined that the personal rights of Child #1 were violated by Staff #5 This poses an immediate health and safety risk to children in care.
Based on interviews conducted by LPA Mireya Garcia on September 21, 2022 and October 12, 2022, it was determined that the personal rights of Child #1 were violated by Staff #1 and by Staff #4 on two separate occasions. This poses an immediate health and safety risk to children in care. 8 Per Head Teacher the Principal will submit via email to LPA Garica a compliance/action plan to ensure staff are in compliance with Tittle 22 regulations, in order to clear this citation.
Per Principal, she has provide training to all staff in regards to personal rights and demonstrated CCLD personal rights video (https://ccld.childcarevideos.org/child-care-center-operators/childrens-personal-rights-in-child-care/) to ensure that staff is following Title 22 Regulations. During LPAs interviews conducted with approximately (6) staff and (8) day care children, a staff witness, Child #7, and Child #9 confirmed information regarding Staff #1 violating a child’s personal rights on two separate occasions.This poses an immediate health and safety risk to children in care. 8 Principal will submit the training agenda, materials and staff sign in attendance for the training to CCLD by or before 06/03/22 in order to clear this citation.
Based on LPA’s interviews conducted disclosures confirmed by staff that incident took place where parent asked to come inside facility and Principal denied parent entry. Interviews with ten day care parents confirm that parents are denied entry and are not allowed to enter the facility due to COVID. This poses a potential health and safety risk to children in care.
