101175 Waivers and Exceptions for Program Flexibility (b) The Department has the authority to approve the use of alternate concepts, programs, services, procedures, techniques, equipment, space, personnel qualifications or staffing ratios, or the conduct of experimental or demonstration projects, under the following circumstances: (1) Such alternatives shall be carried out with provisions for safe and adequate services, and shall in no instance be detrimental to the health and safety of any child in care. The facility must adhere to her outdoor waiver limitations and requirements. The facility owner states she will reduce the number of children outdoor and provide Licensing with a written plan/schedule to comply with the outdoor facility waiver by August 1, 2022. A written plan and schedule will be sent to LPAs. Based on observation and interview, the facility did not comply with the Departmental-issued outdoor waiver, a ratio of one teacher to two children in a public park. records review, Licensee failed to ensure all employees had a criminal record clearance associated to the facility prior to employment, posing an immediate health and safety risk to children in care. The review of the staff file confirmed that four staff did not have a criminal record clearance. $100 CIVIL PENALTY ASSESSED for each staff.
