PERSONAL RIGHTS: The licensee shall ensure that each child is accorded the following personal rights...To be accorded dignity in his/her personal relationships with staff and other persons. Facility Representative states has contacted Licensing advocate for Jane Cong-huyen, Southern California for assistance in addressing child#1's behavior issues for assitance and was connected to CIBC who will observe the child and provide guidance and training to staff beginning 11/13/23. Based on interviews and record review the Licensee did not comply with the regulation above as staff #1 physically removed child from a tricycle causing child to fall when there was no danger to the child in remaining, which poses an immediate health, safety, or personal rights risk to children in care 8

Based on interviews and record review it was determined that a child sustained an allergic reaction due to staff negligence in not checking the allergy list for Child #1 before feeding the child a documented allergen for snack. This poses an immediate health, safety, or personal rights risk to children in care.

Based on interviews & documents reviewed facility did not provide adequate supervision to child 1 relying on a gate,not direct supervision to keep child in the classroom, which poses a potential health, safety or personal rights risk to children in care.

Based on water testing results and interviews, facility tested over the Action Level Exceedance level at 1 faucet (Faucet "C"), which Director states is never used for food preparation or drinking water. This poses a potential health, safety or personal rights risk to children in care. 8 staff and children continue to use only sink “A" for drinking water and food preparation. All staff have been informed not to use faucet "C" for drinking water or food preparation and it has been made inaccessible with sign placed on it stating they it is out of order.

Facility staff did not adequately supervise day care child.
