(a) A licensee shall not operate a child care center beyond the capacity and limitations specified on the license, including the capacity limitation. 1 Site Supervisor agrees to review ages of children enrolled and verify that no children under 3 are being cared for at the facilty. Site Supervisor agrees to create a document that clearly shows children's start dates at the center and will write a statement, stating that she understands that the facility cannot accept children under three (3) years old. This requirement was not met as evidenced through review of the facility records and the interview with the Site Supervisor as a child under three (3) years old was found to be attending the center. This poses a potential risk to the health, safety, and personal rights of children in care. 8 Supporting documentation to be submitted by the Plan of Correction due date, October 25, 2024.
Based on interview and record review, the licensee did not comply with the section cited above which poses a potential health, safety or personal rights risk to persons in care. Licensing Program Analyst (LPA) observed that staff #2 was missing proof that she received the immunization for Pertussis (Tdap) in her employee file. Staff #2 stated that she was not sure if she ever received the immunization for Pertussis.
