Based on record review, the licensee did not comply with the section cited above by not having LIC 700 "Identification and Emergency Information" in 3 out of 3 infant files which poses/posed a potential health, safety or personal rights risk to persons in care.

Based on interviews and self report the licensee did not comply with section above by staff grabbing a child's pants, causing the child to slip, fall, and bust their lip on the play structure in the classroom. This is considered an immediate health, safety, or personal rights risk.
Based on interviews the licensee did not comply with section above by having staff reuse bottles of formula/breastmilk that had already been fed to a baby during a previous feeding. Facility will also have infant staff write their understanding of formula and breastmilk storage and feeding guidlines.
(f)Teachers shall visually observe aides whenever aides are working with infants, except as provided for in Section 101416.5(d)(1). Provide for LPA schedule that shows what classroom each teacher is in and how breaks will be handled so there is always a qualified teacher in the classroom. This requirement is not met as evidence by staff interviews revealing the faciliy were using aides to supervise the infant classroom with children awake. This posed a potential Health and Safety risk to child in care.
Based on observations and record reviews, the licensee did not comply with the section cited above in 3 out of 6 staff files were incomplete, which poses/posed a potential health, safety or personal rights risk to persons in care.
If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible. This requirement was not met by envidence by Director will post safe sleep, training on the wall of the crib area, and a name to face form for signatures to comfirm staff training will send a photo to LPA. LPAs observed an infant sleeping in the rocker and the teacher moved the child into crib after 3 minutes. This is considered an immediate health, safety, or personal rights risk to children in care. 8
To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement is not met as evidenced, Licensing staff learned that Staff #1 was consuming alcohol while supervising children during nap time. 1 Interim Director will have a meeting with staff who are currently employed regarding children's personal rights. A meeting agenda will be provided to LPA Washington to clear the deficiency. LPA's email is tanya.washington@dss.ca.gov This is an immediate risk to the health and safety of children in care. 8
Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. 1 Interim Director was provided a blank LIC624 form and reporting requirements were discussed. Interim Director will submit the form to the Regional Office by POC date of 04/12/2024. tanya.washington@dss.ca.gov In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement is not met as evidenced. LPAs learned that Staff #1 was consuming alcohol while providing care and supervision to children. This incident was not reported to the Regional Office.
(a) A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on observation and interview, this requirement was not met, evidenced by: 1 Director stated that she will submit an application to add a toddler component to either the infant or preschool license. LPAs observed 5 infant children in the "yellow classroom" that was licensed and intended to be used for the preschool component. The only room licensed for the infant component, is the green room. 8
Staff interviews revealed that Child #1 came into contact with a restricted food item resulting in Child #1 having a breakout to the face, near the mouth area. 1 Director stated that she will continue to communicate allergies via their allergy list and communication amongst staff. Director stated she will conduct a staff training and submit proof to LPA Tillery. Staff members stated that they believe Child #1 grabbed a snack from a friends plate, while staff were not looking.
LPAs observed Staff #2, an aide with no untis, supervising 7 children without the supervision of a Teacher. 1 LPA will return to clear the deficiency.
(b) There shall be a ratio of one teacher for every four infants in attendance. This requirement was not met, evidenced by: Staff #2, an Aide, was observed supervising 7 children alone, without a teacher present. LPA will return to clear the deficiency.
(a) Personnel records shall be maintained on the licensee, administrator, and each employee, and shall contain specified information. Based on observation and record review, this requirement was not met evidenced by: 1 Director will send Staff member qualifications by POC date. LPA will return to review all staff files. LPA reviewed 3 staff personnel files and all files were observed to be incomplete. 8

Director stated that the yellow room was an extension to the infant room. Director was mistaken and thought her license allowed her to operate as if she had a toddler option. 8
(a) Personnel records shall be maintained on the licensee, administrator, and each employee, and shall contain specified information. Based on observation and record review, this requirement was not met evidenced by: 1 LPA will return to review files LPA reviewed 4 staff personnel files and all files were observed to be complete. 8
(f) Cribs shall be free from all loose articles and objects, including blankets and pillows. This requirement was not met, evidenced by: Interview with staff member revealed that, on at least one occassion, a blanket was placed in the crib with a sleeping infant. This poses an immediate risk to childrn in care. 1 Staff will sign off on a form, created by the Director, that shows proof of conducting a training in regards to infant safe sleep regulations. Director will submit proof of removing items from the crib. Director will submit this form to LPA Tillery.
Infants who are unable to hold a bottle shall be held by a staff person or other adult for bottle feeding. At no time shall a bottle be propped for an infant. This requirement was not met, evidenced by: Interviews with staff revealed that blankets are being used to prop the infants bottle for feeding. This poses a potential risk to children in care. 1 Staff will sign off on a form, created by the Director, that shows proof of conducting a training in regards to infant care food services. Director will submit this form to LPA Tillery.
