Necessary equipment shall include, but not be limited to: (C) Refrigeration. This requirements not met evidenced by: Director stated replacement refrigerator will be moved from 3rd floor to an infant room ASAP. Per Director she will ensure it is working properly. Per staff memebers, refrigerator does not keep cold temperature.LPA observed children`s food (milk, yougurts) stored in the refrigerator and freezer at degrees above 45F. Temperature in the freezer measured at 60.62 F(15.9C) and refrigerator at 61.8 F(16.6 C). 8

Based on staff#1 interview on 07/15/24, on 06/10/24 child#1’s parent observed child#1’s Epi-Pen was stored in the infant classroom refrigerator. Epi-Pen can not be stored in the refrigerator. Based on staff interviews and LPA’s observation on 05/14/24, from 11:40 AM to 1:00PM, LPA observed two infants were napping in nap room, alone with nap room door closed. Staff did not have auditory supervision to napping infants. This poses an immediate health, safety, and personal right risk to the children in care. 8 classroom to have one staff in nap room when an infant is napping and meet the teacher child ratio requirements. A written plan will be submitted to LPA by 04/22/24. Per staff#1, facility director, staff#3 has been suspended as of 03/20/24. Parents and staff were informed. Per staff#1, they did not have a designated teacher to act as director since director absence. This poses a potential health, safety and personal right risk to the children in care. 8

... 1 Per director, Per director, two infant teacher assistants who had teacher qualifications on file were promoted to teacher effective 12/27/2021 and one fully qualified teacher was hired on 12/27/21. Per director, effective 12/27/21 Infant and preschoolers children have not commingle together anymore in the mornings or operate out of ratio. LPA Eivazian sign in/out sheets from 11/01/21 to 12/20/21 and observed in different days there were about 13 to 25 children (infants and preschoolers) present in the facility between 7:30 a.m. and 8:30 a.m. with one teacher and two teacher assistant.
