101223(a)(1): Personal Rights(a): "The licensee shall ensure that each child is accorded the following personal rights: (1)To be accorded dignity in his/her personal relationships with staff and other persons" This requirement was not met as evidence by: 1 Facility was proactive and offered trainings and resources for staff and families. Director will submit documentation of trainings received by staff and have a written statement signed by all staff acknowledging they understand proper procedures to follow, including properly reporting incidents. Based on observation, interviews, and record review, the facility did not comply with the section cited above as a child sustained bites by peer while in care, which poses a potential Health, Safety, or Personal Rights to Persons in care. 8 Director will email LPA Alvarado proof of trainings from all staff by 10/25/24.
101216.3: Teacher Child Ratio:(c): Child development programs funded by the California Department of Education and operating under Title 5 of the California Code of Regulations are not required to meet the teacher-child ratios specified in (a) and (b) above. Title 5 staffing ratios shall apply in such centers." This requirement is not met by: 1 Per Title 5 regulations, Toddlers (18 months to 36 months old) - 1:4 adult child ratio. Facility must maintain appropriate teacher to child ratio at any given time. Based on observation, interview, and record review, Facility did not comply with this section cited above as LPAs observed 12 toddlers with 2 staff members, which poses an imediate heath, safety or personal rights risk to persons in care. 8 Facility will submitt a schedule for each classroom reflecting appropriate Teacher to Child ratios to LPA Alvarado by End of Day, 7/19/2024
101439: Infant Care Center Fixtures, Furniture, Equipment and Supplies: (g) "Furniture shall be maintained in good repair and safe condition." This requirement is not met by: 1 LPAs pointed out safety concers to the Director to show that a child could have been potentially hurt. Based on observation and interview, Facility did not comply with this section cited above as LPA’s observed a larger crib in classroom 5 with an infant child inside of the crib with the latch lock faced forward and partially unlocked, which poses a potential Health, Safety or personal rights risk to persons in care. 8 Director will speak to staff on proper actions to taken when infants are in use of the larger crib. Facility will submitt a signed written statement from staff acknowlaging the proper actions to take when infants are in use of the larger crib to LPA Alvarado by 7/25/24
101439.1:Infant Care Center Sleeping Equipment: (f) "Cribs shall be free from all loose articles and objects, including blankets and pillows." This requirement is not met by: 1 LPAs explained safe sleep regulations to director. Director immediately took the blanket out of the crib. Based on observation and interview, Facility did not comply with this section cited above. At approximately 9:15am, in the back side of classroom 5/8 (sleeping room), LPAs observed a pink blanket in one of the infant cribs with no infants present, which poses a potential Health, Safety or personal rights risk to persons in care. 8 Facility will share safe sleep regulations with staff and families and provide proof of completion to LPA Alvarado by 7/25/24
101429(a): Responsibility for Providing Care and Supervision for Infants: (2) "Sleeping infant(s) shall be directly observed by sight and sound at all times...(C) Documentation shall be maintained... and be available to the Department for review. Documentation shall include the following:1. Date, 2. Infant’s name,.3. Time of each 15-minute check, 4. Initials of staff person who conducted each check." This requirement is not met by: 1 LPAs explained safe sleep regulations to director. Sleep logs must be maintained for all children until age 2. Director provided infant sleep logs to staff during inspection. Based on observation, interview, and record review, Facility did not comply with this section cited above as Sleep logs that were provided to LPA’s were from March 2024 and prior which poses a potential Health, Safety or personal rights risk to persons in care. 8 Facility will send a copy of sleep logs for 7/18/24-7/25/24 to LPA Alvarado by 7/25/24. Facility will continue to maintain sleep logs for future review.
101416.3(b): Infant Care Aide Qualifications and Duties: "An infant care aide shall work under the direct supervision of the director, the assistant director or a fully qualified teacher, except as provided for in Section 101416.5(d)(1)." This requirement is not met by: 1 Facility will ensure that unqualified staff are under the direct supervision of a qualified staff. Based on observation and interview, Facility did not comply with this section cited above. At approximately 9:35am, LPA’s observed an unqualified staff alone with a group of 3 infants leave the classroom which poses a potential Health, Safety or personal rights risk to persons in care. 8 Facility will submitt a schedule reflecting assistant teachers under the direct supervison of a qualified staff to LPA Alvrado by 7/25/24
