(b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below: (1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. (A) After employment, a teacher hired under (b) above shall complete, with passing grades, at least two units each semester or quarter until the education requirement specified in (c)(1) below is met. Deficient Practice Statement Based on the record review and observation, the Licensee did not meet the above regulation which poses an immediate safety risk to the children in care. During the facility tour LPA observed S7 providing Supervision & Care to children in care as a Lead Teacher. During file review the LPA was unable to review transcripts with required courses for S7. S7 is not currently enrolled in any courses.

During review of medication the LPA observed several expired medications for children who were no longer enrolled.

Based on the interviews conducted with staff and documents reviewed, the facility made changes to the original admission agreement and authorized representatives were not notified or given the amended admission agreement to date/sign. This 8 Director re-implemented the afternoon snack on the day the 10 day was initiated, effective July 1, 2023. Director understands any modifications made to the original admission agreement must be dated and signed for. Director agrees to submit a written statement of understanding of the regulation.

(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility:(2) Request a transfer of a criminal record clearance as specified in Section 101170 (f). 1 have a Criminial Record Clearance associated to the facility. Director stated an email was sent to the Department requesting association, however, the email was unable to be located by the Director. This requirement was not evidenced by: Based on record review, the Licensee did not meet Criminal Record Clearance which poses an immediate Health, Safety & Personal Rights risk to the children in care. During the inspection LPAs observed S1 providing Supervision & Care and did not 8 Director agrees to send required documents to the Department to have S1 associated and understands S1 cannot work until S1 is associated. Civil Penalty assessed. $100 per day for 5 days.
