(a)The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation...This requirement was not met as evidence by: 1 Per the Director, we will suspend the child if they are hitting or bullying and document to the parent and if it continues we will put the child on the ABC chart and track the behavior and if that doesn't work, we will contact the Administrator and possibly remove the child. Based on interviews and record reviews Child 1 was smacked in the face by another daycare child while in care. The staff did not follow behavior guidance to prevent the incident from occurring which is a potential health, safety, or personal rights violation to the persons in care.

Based on observation, interview, and, record review, the licensee did not comply with the section cited above in completing a water lead test by required date and submitting proof to Licensing which poses a potential health, safety or personal rights risk to persons in care.

Based on observation, interview, record review, the licensee did not comply with the section cited above in three staff were not associated or fingerprint cleared which poses a potential health, safety or personal rights risk to persons in care.

Based on observation, interview, and record review, the licensee did not comply with the section cited above in the Site Director was not designated as supervisor and Licensing does not have record which poses a potential health, safety or personal rights risk to persons in care.

Allegation #1- Staff did not prevent child from bullying another child in care.
