Based on incident report submitted to regional office, interviews conducted and viedo footage. Child #1 sustained an injury fractured right leg from tumbling down a book shelf. This incident poses an immediate risk to the health and safety of children in care.

(a) The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified (b) in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidence by: Per Staff #1 and video footage staff #1 left classroom at 5:25pm to the front office area and returned to classroom #1 at 5:39pm. When parent arrived at the facility, staff #1 realized child #1 was in the classroom. 1 Per Reginal Director professional development training was conducted on 01/19/2026 and addressed standard operation procedures and classroom expections. An additional training will be conducted on 02/16/2026. Facility has implemented name to face check in every 30 minutes on App Tadpole. Facility will provide record of attendance with an agenda to LPA Msilva within 5 days of training.

This requirement is not met as evidence by: According to interviews with S1 to S3, it was disclosed that on 06/05/2025 while children were being transitioned from one classroom to another, C1 was left unattended in the classroom for approximately 5 minutes.

An infant fell asleep and the 1 Director states the staff member is no longer working at the day care. Director also states all staff who work in the infant/toddler class rooms will be retrained on children's personal rights and infant safe sleep. Director will provide to the department a copy of each training agenda and the sign in/out sheet for staff member placed the infant on the carpet and not in the crib and attended to another child, which poses/posed an immediate health, safety or personal rights risk to persons in care. 8 each staff member who attended the training's, the plan of correction date of 05/23/2025

Personal rights §101223(a)(2)
Director sent LPA copies of mask wearing posters she has placed in and around the facility as well as had all staff sign and date a statement regarding wearing a mask in the facility. Director will update the signed statements to reflect that they will wear mask and will wear them properly. Director will also update the signed document to reflect Per LPAs own observation of some of the staff wearing their mask under their nose, including the assistant director and per interviews with staff, some stated their mask slip off their noses and its hard to keep it on completely. This poses a potential risk to the health and safety of children in care 8 that this is a requirement by the California Department of Public Health (CDPH) Guidance on the Use of Face Covering and a personal rights issue under title 22 regulations.
