101223 Personal Rights(a)The licensee shall ensure that each child.(3)To be free from corporal or unusual punishment...interference with functions of daily living including eating, sleeping or toileting... medication or aids to physical functioning. 1 Facility Representative stated she will submit a written plan for coverage. Facility does have two floaters for coverage yet her goal is to hire a qualified teacher for infant classrooms. Facility has a Staff Development Day scheduled for June 19, 2026 and will cover personal rights regulations with staff. Based on interviews, 4 out of 6 staff members stated they witnessed staff interrupting the daycare children while napping. Staff #3 (S3) stated they observed S1 moving a crib from one room to the other. S3 stated, children should be sleeping without being interrupted and moving their crib is interrupting their sleep, which poses a potential health and safety risk to the children in care. 8
Based on interviews, four out of four staff stated that they have heard or observed that while S4 was holding C1, and S2 attempted to grab C1 out of S4's arms. This poses an immediate health, safety or personal rights risk to persons in care.

Based on interviews three (3) out of five (5) staff members stated that they have heard or witnessed C1 being sprayed with water on C1 face to keep C1 awake. If an infant falls asleep before being placed in a crib, staff shall move the infant to a crib as soon as possible. 1 Facility states that they will conduct an infant care activities regulation meeting with all staff members and submit proof to the department by the date of 10/31/2025 to ensure the personal rights of children in care. Four (4) out of five (5) staff interviewed stated that they observed a child asleep in a chair. LPA obtained camera footage of C1 asleep in chair for more than 10 minutes and documentation of warning for S3 & S4. This poses an immediate health, safety or personal rights risk to persons in care. 8
101427 Infant Care Food Service (c) The infant shall be fed in accordance with the individual plan. This requirement is not met evidenced by: 1 Director states facility will have staff sign policy and procedures reminders, including needs and services plan for infants to ensure scheduled feeding times. Director will submit proof of the signed master copy with all staff signatures to LPA by due date 9/26/25. Based on record reviews, C1’s 05/09/2025 Daily Report showed no record of bottle being provided to C1, facility did not follow Needs and Services Plan’s bottle-feeding schedule: “6am and every three hours. Keep offering every 30 minutes until bottle empties”, which poses a potential health, safety or personal rights risk to persons in care. 8

This evidence has not been met by: 1 On 2/3/25 S2 arrived for support at 9:30AM and Director stated they will go over Infant-Staff Ratio and email a copy of agenda to LPA by 2/4/25 with staff signatures. Based on observation and interview: At 9:25AM, LPA Navar observed 1 staff member (S1) providing care for 5 infants in the Infant classroom. S1 stated they need to call for back up. 8

Based on LPA’s staff interviews, two (2) staff members in Infant Room #3 did not observe an incident on 02/20/2024 involving C1 sustaining a bite on the right cheek by C2. The bite did not break skin but left a quarter size mark on C1. This poses an immediate health, safety or personal rights risks to persons in care.
Based on LPA's interviews and record review, C1 had 10 incidents of biting total and facility did not follow biting policy to prevent injuries to other infants. This poses an immediate health, safety or personal rights to persons in care.
Based on intervirew with staff, a child was bitten on the face and staff did not call front desk for assistance and instead waited 15 minutes to apply an ice pack to the child. This poses a potential health, safety or personal rights risks to persons in care.
Director stated a policy change will be implemented on 02/28/2023 to check and/or change daipers on a tailored schedule for each child. Each account on Tadpoles application will alert staff every hour to check child's diaper. Director will email LPA a random sample of daily reports for review on 03/03/2023. LPA interviews with Reporting Party, Director, 4 staff members and 1 parent, it was discovered that subject child and other children who attend the facility are receiving a diaper change over 2.5 hours after their last diaper change, causing a rash on the child. Children need to be changed as needed. This poses an immediate risk to the personal rights of children in care.
