Personal Rights:(a)The licensee shall ensure that each child is accorded...personal rights:(3)To be free from corporal or unusual punishment,... humiliation, intimidation... threat... or other actions of a punitive nature …This requirement is not met evidenced by: Per Facility Representative, she will conduct training with all staff members. In the training she will discuss children`s personal rights, supervision, handling chalenging behaviours, safe enviroment. Agenda will be sent to LPA by POC date. Per video footage provided to LPA on 02/13/25, S3 pulled the child from the shoulder and forced them to sit in rough manner, which poses/posed a potential health, safety or personal rights risk to persons in care. 8 Additionally, Director stated she will conduct the meetings every months or often, when new staff member joins. Director statted they will follow up with Technical Support Program for additional resources and trainings.

S2 records were reviewed and observed 12 ECE units were not issued from approved or accredited school, which poses a potential health, safety or personal rights risk to persons in care. 8

101238 Buildings and Grounds (a)The childcare center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. This requirement was not met evidenced by: 1 Director statted, glass table removed from the facility and shelfes were placed against the wall and secured to the wall. Child 1 was startled and cried during the nap time when bookshelf tipped, and toys fell on the child .Child 2 hit their head on the glass table getting deep cut on the forehead. 8

Licensee stated she will send a written plan how the facility will handle children with chalenging behaviours and she will meet with the staff to review children`s personal rights, how to handle chalenging behaviours. Licensee stated she will send meeting agenda with the written plan to LPA by POC date. S1 admitted pulling C1 from under the table leaving a bruise on C1 hand. 8

Based on LPA Eivazian file review, the licensee did not comply with the section cited above in 1 out of 6 staff, staff#2 did not have active and current criminal record clearance in licensing system which poses/posed a potential health, safety or personal rights risk to persons in care. During this inspection staff#2, (2-3 years old classroom) teacher does not have criminal record clearance on file. During this inspection LPA Eivazian contacted the office and talked to support staff Telly Bilbrew who stated staff#2 was cleared and case was closed in November 2020. During this inspection director showed DOJ Applicant Fingerprint Responds letter and Request for livescan service form (LIC9163) to LPA Eivazian. LPA talked to LPM Gabelman and agreed to cite this violation as Type B citation and no civil penalty.
