Based on observation, interview, record review, the licensee did not comply with the section cited above in cleaning solutions were made accessible to children in care which poses/posed a potential health, safety or personal rights risk to persons in care.

Reporting Requirements: Upon the occurrence, during the operation of the child care center of any of the events specified in (d)(1) below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in (d)(2) below shall be submitted to the Department within seven days following the occurrence of such event. This requirement was not met as evidence by 1 Director stated she will submit to the department no later than 03/29/22 an unusual incident report concerning the alleged incident that occurred on 11/10/21. Based on LPAs observations and interviews which were conducted and record review, it was determined that on 11/12/21 facility was made aware of the alleged incident that occurred on 11/10/21, however the incident was not report to the department within 24 hours and a written report within 7 calendar days. This is a type B deficiency that if not corrected poses a potential Health and Safety risk to children in care. 8
