Based on analyst observation, the facility did not comply with the section cited above as when analyst arrived in the infant classroom a teacher and aide were supervising nine children putting them out of the regulation required 1:4 staff to infant ratio which poses/posed a potential health, safety or personal rights risk to infants in care. 8 Director understands that sufficient staff must be present at all times, via program floaters or substitute staffing progratms, to ensure teacher/child ratios are being met. Director advised analyst she is also in the process of interviewing and hiring as many as two additional staff members to help meet the requirement.

Based on records reviewed and information obtained, the licensee allowed Terri Bercasio to act in the capacity of and/or on behalf of the licensee for an undetermined amount of time without a criminal record clearance or a criminal record exemption as required, which poses an immediate health and safety risk to children in care. 8 Facility Representative, Director, Rachelle Wise was advised that the case will be referred to the Department's Legal Division for potential Administrative Action.
