Based on the evidence gathered, an infant was observed to be swaddled and sleeping on a boppy pillow during nap. LPA confirmed during the inspection that the boppy pillow used by the infant was in the room.

Abigail Hernandez did not have a fingerprint clearance associated to the facility. According to Mrs. Low, Rabi Josh Dorsch helped in the infant room to supervise napping infants on Oct. 11th and 12th. Rabi Dorsch did not have fingerprint clearance on file.

1597.055(a)(5) Day care center teachers; qualifications: Notwithstanding any other educational requirements, a person may be hired as a teacher in a day care center if he or she satisfies all of the following conditions:...Has provided evidence of a current tuberculosis clearance...This requirement was not met as evideced by: 1 Director states only qualifed staff will be allowed to supervise children. The center will ensure all staff meet qualifications prior to being employed and supervising children by thoroughly reviewing records. Center director has provided a statement to acknowledge this requirement atr the conclusion of the visit. Based on interviews with staff, on 10/11/21 and 10/12/21 unqualified staff was left alone to supervise in the infant classrooms. This poses a potential health and safety risk to children in care. 8
