A child ran from a playground, through Director, Aunica DeFalco agrees to install a child proof latch on the gates to make them more inaccessible to children in care. a gate, through the back door of the facility, down the hall inside the parking lot while being pursued by staff. The child stopped running and turned around toward the front door of the facility before being brought back inside. This poses an immediate risk to the health and safety of the children.

101700.3 (b) (1) California Lead Action Level at Child Care Centers...A result with values of 5.5 ppb or greater shall be deemed an Action Level Exceedance. This requirement was not met as evidence by: 1 Director Aunica DeFalco placed the water outlet out of service and replaced faucets C and H on 1/3/2023. Faucet I was removed on 1/3/2023. The facility is providing bottled drinking water to children in care. Correction will be deemed complete once retest results are below 5.5ppb. Water testing results taken on 12/3/2022 with an Action Level Exceedance of 19, 38, and 21, which is higher than the allowable limit. The faucets are in classrooms 3 and 6, labeled C, H, and I. This poses a potential health, safety, or personal rights risk to the children in care. 8

This requirement is not met as evidence by: 1 Director will submit a written plan of action detailing how Staff will actively supervise children indoors and outdoors. Director will include a staff schedule for the day time and afternoon, as well as documentation from the upcoming In-Service training. The plan is due to LPA by plan of correction date of October 7, 2022. Based on interviews conducted and LPAs observation, staff failed to properly supervise C1 on two separate occasions, where C1 changed out of soiled clothing without staff's knowledge, and C1 had rubber wood chips in underwear from the playground, which poses a potential health, safety or personal rights risk to children in care. 8
