Based on observation, the licensee did not comply with the section cited above. LPAs observed the carpeting in the Squirrels classroom that is frayed, posing a tripping hazard. This poses a potential health, safety or personal rights risk to persons in care.

To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidence by: 1 Facility representative Zina Rabinovich stated that a warning was issued to the staff after the incident and the staff understands that this or similar incident shall not happen again. On 07/20/2023, a staff member covered an infant's mouth for a couple seconds as the infant was crying. This incident was observed by several individuals. This poses an immediate health and safety risk to clients in care. 8
There shall be a ratio of one teacher for every four infants in attendance. This requirement is not met as evidence by: 1 Facility representatives stated that they have adjust the staff members schedule to accomodate the early morning drop off. Director will submit the updated LIC500 personnel report to Licensing no later than10/06/2023. Based on interviews conducted the licensee did not comply with the above regulation as there have been multiple days that both infant classes are out of ratio in the early morning. This poses a potential risk to the health and safety of children in care. This is a repeat violation and civil penalty of $250 is being assessed today. 8
Bottles and dishes provided by the authorized representative shall be rinsed and returned to the authorized representative for sanitizing at the end of each day. This requirement is not met as evidence by: 1 Facility representatives stated that all the infants, toddler's parents and staff members will be informed that the dishes, bottles, pacifier and zippy cups are to be returned to the authorized representatives at the end Based on interviews conducted with staff and parents. The children's zippy cups are kept at the facility in the older infant classroom and it does not get return to the authorized representative at the end of the day. 8 of each day. Director will send a message to all the parents and staff through Brightwheel next week and she will submit a screen shot of the written statement to LPA no later than 10/06/2023.
In the case of less serious injuries including, but not limited to, minor cuts, scratches and bites from other children requiring assessment and/or administration of first aid by staff, the licensee shall document the injury in the child's record and notify the child's authorized representative of the 1 Director stated that they will provide training with the staff members that any injury to a child, no matter how small including scratch, small bite or mark needs to be documented and notify the parent. nature of the injury when the child is picked up from the center. Personal Rights-Licensee shall ensure that each child is to be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. Director was provided with the choking hazard food published by the center for disease control (CDC) and prevention. Facility representatives stated that effective immediately the facility will stop serving raisins, craisins This requirement is not met as evidence by: Per interviews conducted with staff members, day care parents, the facility serves children choking hazards food including raisins and craisins. This poses a potential health and safety risk to children in care. 8 and other food that may be choking hazards according to the CDC flyer.
((h) Infant Care Food Services Infants who are unable to hold a bottle shall be held by a staff person or other adult for bottle feeding. At no time shall a bottle be propped for an infant. An infant shall not be allowed to carry a bottle while ambulatory. A bottle given to an infant able to hold his/her own bottle shall be unbreakable. 1 Director stated that she will provide staff members with the regulation that states that at no time shall a bottle be propped for an infant. Director will submit the list of staff members names along with their signature as correction by 06/30/2023. This requirement is not met as: Information gathered indicated that there are times that the infants were feed by propping the bottles. This poses a potential Health and Safety risk to the clients in care.” 8
Bottles and dishes provided by the authorized representative shall be rinsed and returned to the authorized representative for sanitizing at the end of each day. 1 Director stated that the staff members now take the bottles from the child's bag and put the cap back inside the bag right away and after each feeding, staff members would rinse the bottles and place it back inside the bag right away to prevent being placed in the wrong bag. This requirement is not met as there has been several incidents that the parents were given another child's bottles. This poses a potential Health and Safety risk to the clients in care.” 8 Director stated that she will provide a written procedure and have staff members sign the form and submit it to LPA no later than 06/30/2023.
An infant shall not be swaddled while in care. This requirement is not met as evidence by: LPAs observed a young infant swaddled while napping in the crib. 1 Director stated that effective tomorrow she will make sure that the infant will not be swaddle. Director will have all infant staff members review the regulation and sign the document that indicates that they have read the regulation by 03/27/23.
The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirment is not met as evidence by: There are 21 infants in care and only 15 are signed in. Director stated that she will inform all staff members to remind the parents to sign in and out daily. And remind all the parents to sign in and out daily as well. Director will submit a written plan of correction to LPA no later than 03/27/2023.
Each caregiver shall wash his/her hands with soap and water before each feeding and after each diaper change. This requirement is not met as evidence by: Director stated that she will provide the regulation information to all staff members that works with infants. She will submit a copy of the agenda along with the staff members sign in sheet to LPA no later than 2/24/2023. Per interview with staff members, staff does not wash hands with soap and water before each diaper change because they were changing gloves after each diaper changing. This poses a potential health and safety risk to children in care. 8
All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1596.871 shall prior to working, residing or volunteering in a licensed facility: Request a transfer of a criminal record clearance as specified in Section 101170(f). Director stated that she will submit the staff's background clearance transfer request to the department before the next business day no later than 2/21/23. Director shall submit a written plan of correction on what This requirement is not met as evidence by: Ssubstitute infant teacher aide Faitan Aboona-Habi has worked at the facility for three days and she is not associated to the facility. This poses a potential safety risk to client's in care. 8 she will do to ensure that the facility does not violate this licensing requirement in the future no later than 2/24/2023.
There shall be a ratio of one teacher for every four infants in attendance.There is a fully qualified teacher directly supervising no more than 12 infants. This requirement is not met. Director stated that she will provide training with staff members on teacher child ratio requirements. A copy of the training information along with staff members sign in sheet shall be submitted to Licensing no later than 2/21/23. LPA observed 13 older infants (room #4) at the playground supervised by three staff members. LPA also obseved 12 older infants that just woke up from nap in the room supervised by two staff as another staff went on a break. This poses a potential health and safety risk to children in care. 8

This requirement is not met as evidence by: Director stated that she send a message to the parents during today's inspection. Facility shall develope a plan on how to ensure that the facility can meet the required regulation. Per review of the facility's sign in sheets, there are 23 infants in care today and only 19 infants are signed in. This poses a potential health and safety risk to children in care. 8 Director shall submit a written plan of correction to LPA no later than 2/24/2023.
Based on interviews with staff members, the licensee did not comply with the section cited above as staff members stated that they change the infant sheets weekly and as needed which poses/posed a potential health, safety or personal rights risk to persons in care.
