Based on LPA's observation and interview with staff, there were tripping hazzards in the play area with uneven ground (turf); plastic borders that are worn out; cracks on the concrete area that poses tripping hazards.
Based on LPA's observation and interview with staff LPA observed paint that were chipping off the inside walls; boys bathroom; infant room; pre-k room and outside play areas. This poses a potential risk to children's health if ingested or inhaled.
Based on LPA's interviews with staff, children stood and played under the A/C unit that has dripping water runoff from A/C in the play area. Staff have been standing directly under the A/C unit to prevent this from happening. Director has installed a bucket tied to the unit to catch water runoff. This is a temporary fix.
Based on LPA's observation and record review, a Fully qualified teacher and a teacher aid with no Child Development credits, were observed providing care for 17 children in the playground. This poses a potential risk for the health, safety and personal rights of children in care.

No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement is not met as evidence by: Director and facility representative Ms. Zina stated that they will informed all the preschool staff members on the regulation reguarding supervision. The topic of the regulation with the staff's name and signature to verify that they understand the regulation requirement of visual supervison Facility has been allowing the children in the four year old class walk to the restroom that is located outside by the playground alone when staff is not available to walk the children. This poses a potential health and safety risk to children in care. 8 will be submitted to Licensing no later than 10/06/2023.
Personal Rights; The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement is not met as evidence by: Director stated that she will provide training with staff members regarding personal rights regulation and provide the training agenda along with the staff members signed in sheet to Licensing no later than 03/27/2023. On 02/24/2023, a staff grabbed a child by the arm/wrist out of the playhouse and forcefully sat the child down while the child was crying. Two person witness the incident. This poses an immediate health and safety risk to clients in care. 8
The person who brings the child to, and removes the child from, the center shall sign the child in/out. This requirement is not met as evidence by: There were 32 children in care and only 26 children were signed in. This is a repeat vilation. Director stated that she will inform all the staff members to remind the parents to sign in and sign out daily. And remind all the parents to sign in and out daily as well. Director will sumbit a written of correction to LPA no later than 3/27/2023.
Based on record review, the licensee did not comply with the section cited above 2 (E.T.) (R.R) out of 5 staff member does not have a valid mandated child abuse training certificate avialable for review, which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on record review, the licensee did not comply with the section cited above 3 out of 5 of the children in care does not have the physician's report available for review, which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on observation,the licensee did not comply with the section cited above, LPA observed a day care child at the playground with teacher aide R.R., a day care child informed staff R.R that there is another child that is still in the restroom. Staff walked to the boys restroom to open the door for the child to join the group at the playground, which poses/posed a potential health, safety or personal rights risk to persons in care.
Based on observation, the licensee did not comply with the section cited above, LPA observed teacher aide R.R. supervising the children from the Foxes classroom at the playground without a teacher, which poses/posed a potential health, safety or personal rights risk to persons in care.
