Based on record review, the licensee did not comply with the section cited above. Documentation was submitted by the Licensee via email, which was falsified. LPAs was able to verify that the documents were altered. Also based on observation, LIC 9224 forms did not have consistent dates and signatures from responsible parties. which poses an immediate health, safety or personal rights risk to persons in care.

Based on records review, the licensee did not comply with the section cited above in that commingling with the infant license is occurring in the preschool classroom between 7:00 am and 8:30 am, which poses an immediate health, safety or personal rights risk to persons in care.
Limitations on Capacity - A licensee shall not operate a child care center beyond the conditions and limitations specified on the license, including the capacity limitation. Based on observation, licensee did not comply with the section cited above. 1 Licensee agrees to cease operation and compose a letter to the parents notifying them of the closure. A copy of the letter is to be submitted to the Riverside Child Care Regional office by 9/7/2022. The facility was providing care for School Age children under an after school program. This poses an immediate health, safety or personal rights risk to persons in care. 8 Request Denied
False Claims - No licensee, officer or employee of a licensee shall make or disseminate any false or misleading statement regarding the child care center or any of the services provided by the center. Based on interview with licensee, the licensee did not comply with the section 1 Licensee agrees to submit a written statement about the understanding of the cited regulation and how compliance will be maintained. Statement to be submitted to the Riverside Child Care Regional office by 9/7/2022. cited above. The licensee claimed not to be aware of the after school program, yet her facility (Whiz Kids Montessori) is the facility being paid for services provided to the School Age children. This poses an immediate health, safety or personal rights risk to persons in care. 8
Based on observation, the licensee did not comply with the section cited above in that carpets are dirty and the tile floors have grime build up, which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation, the licensee did not comply with the section cited above in which LPA observed Kitchen/staff break room to be unsanitary, with the following being observed: Microwave inside and outside was grimy and had food stuck to the outside on the buttons, bathrooms used by the children in care had sinks and toilets that were unsanitary. Toilets had rings in the toilets that were pink and area around the toilets were grimy. Sinks had built up grime and dirt, soap dispenser was leaking soap onto the floor. which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation, the licensee did not comply with the section cited above, LPA observed a trash bag hanging in the fence outside in the playground area that flies were inside and outside flying around in which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation the licensee did not comply with the section cited above in which LPA observed trash cans throughout the facility to not be closed correctly, some had food wrappers in them. Trash cans were grimy and dirty on the area where you push the lid and dispose of the waste which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation the licensee did not comply with the section cited above, LPA observed turf grass has pulled up and has become a tripping hazard for children in care, which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation the licensee did not comply with the section cited above, the top of the refrigerator had food items that had dust and dead bugs, which poses an immediate health, safety or personal rights risk to persons in care.
Based on observation, the licensee did not comply with the section cited above, LPA observed lunch, bean burritos in the classroom in a tupper ware container. According to staff the burritos were prepared at 6:30 am and left in classroom until lunchtime, 11:45 am without being refrigerated. which poses an immediate health, safety or personal rights risk to persons in care.
LPA observed that the fall zone of the spider climber did not Director/Licensee Kathy Chamarty agreed to replenished the entire fall zone with sufficient cushioning material to absorb falls. Director agreed to submit pictures and purchase receipt to Community Care Licensing as proof of correction. Meanwhile, director stated that the spider climber would not be used by children until correction has been have sufficient cushioning material to absorb falls. LPA observed a thin layer of rubber barks underneath and around the spider climber with hard-packed dirt exposing in several spots of the fall zone. A child fell from the spider climber on 9/3/2021 and received fractured elbow. 8 made. A written statement with staff signatures and pictures will be submitted by 9/29/2021 on temporarily preventing access to the spider climber. Pictures and purchase receipt of additional cushioning material will be submitted by 10/4/2021.
Director Kathy Chamarty agreed to review Section 101212 and submit written statement of understanding to Community Care Licensing by 10/4/2021. A child fell from the climber on 9/3/2021. The director admitted that they had knowledge on 9/5/2021 or 9/6/2021 that the child went to the doctor and was diagnosed a fractured elbow from the incident. Facility failed to report the incident to Community Care Licensing until 9/17/2021.
